Every Orange County employer with one or more employees must register with CalSavers or sponsor a qualified retirement plan and certify an exemption. The last phase-in deadline — 31 December 2025 for businesses with 1–4 employees — has passed, and the mandate now runs on a rolling annual cycle. Non-compliance costs up to $750 per eligible employee in the first cycle, then $500 per employee per year. Orange County's 160,810 private establishments are all inside this system.

How the employer base breaks down by size
The establishment totals above come from BLS Quarterly Census of Employment and Wages, which counts every establishment covered by unemployment insurance. The size breakdown below comes from Census County Business Patterns, which counts establishments with paid employees on a narrower definition — so its base is smaller. Both are published figures; we show each with its own source rather than mixing them into one number.

Two readings matter for the mandate. Almost nine establishments in ten have fewer than twenty employees, which is the group the final phase-in deadline reached — and the group least likely to have a plan already. And the 20-to-99 band, 40,557 establishments across the two counties, is where a plan of your own usually beats CalSavers on cost once the SECURE 2.0 credits are counted.
What we can say without size-band data: the mandate does not care about size anymore. One employee is enough, whether you run a two-person shop in Fullerton or a sixty-person operation in Anaheim.
What an Orange County employer must do now
