The short answer

Orange County carries a defense and aerospace supplier base that predates its business parks: electronics, circuit boards, connectors, RF and power components, precision assemblies and engineering services, through Anaheim Canyon, Santa Ana, Fullerton, Huntington Beach and Irvine. Two active military installations sit inside the county line. Most of these firms have a plan already; what they need reviewed is cost, fiduciary process, and how federal fringe rules interact with it.

Where do aerospace and defense suppliers cluster in Orange County?

The county's defense work concentrates in its older industrial districts rather than its signature master-planned parks. Anaheim Canyon, in the northeast of the city off the 91, is the densest of them, with Santa Ana's industrial core continuing it and Fullerton, Placentia, Brea and Orange running north and east. Huntington Beach holds a long-standing aerospace and defense presence inland of Beach Boulevard. Irvine and Costa Mesa sit at the engineering and product end — design houses, test and instrumentation, and the defense technology companies that have chosen the county for headquarters, Anduril Industries in Costa Mesa most visibly among them.

What is made here differs from what is made in the South Bay. Orange County's strength is electronics and subsystems rather than structures and large machined parts: printed circuit board fabrication and assembly, connectors and interconnect, RF and microwave components, power supplies and conversion, sensors and instrumentation, harnesses, and the engineering services and integration work around them. Precision machining exists and serves both defense and the county's medical device cluster, which is a mix a South Bay shop rarely has to manage.

Then there are the installations, which almost nobody counts as part of the county's economy. Naval Weapons Station Seal Beach and the Joint Forces Training Base at Los Alamitos are both active, both inside Orange County, and both surrounded by the contractor economy that any military installation generates: facilities maintenance, grounds, security, logistics, IT support, training support and construction. Those are services contracts, and services contracts are where federal fringe benefit rules bite hardest — which is why the plan question here is not the same question a product manufacturer is asking.

What makes this industry harder than the mandate assumes?

The law treats every employer alike. The payroll underneath does not cooperate:

  • Federal fringe benefit obligations on services contracts require a vehicle that can accept employer money, and the state programme cannot accept any.
  • Cybersecurity and quality flowdown from primes has landed on firms with no compliance staff, and benefits review loses every time to the requirement with an audit date.
  • Engineering and test talent is recruited by Irvine technology and medical device employers paying on a different scale within a twenty-minute drive.
  • The plan is usually a bundled product placed years ago with no named fiduciary, no investment policy statement and no documented review.
  • Program awards move headcount in steps rather than gradually, pushing firms across testing and audit thresholds between one year and the next.

Typical headcount in this sector runs 20-500 employees, and roughly 65-80% of firms (est.) currently sponsor a plan of any kind — which is why the mandate lands here harder than in sectors that were already covered.

What plan design actually works?

If any of your revenue is covered services work, design the plan around the fringe mechanics before anything else: a distinct employer contribution source, an allocation that tracks hours worked on covered contracts, and vesting terms consistent with the rules that govern fringe contributions. Getting this right also changes what the contribution costs you overall, since amounts contributed to a plan are not wages. It is exacting, the Department of Labor audits it, and it belongs in the document from day one rather than bolted on in year three. For the commercial side of the same company, a safe harbor 401(k) removes the testing risk that a firm with a few highly paid engineers always carries.

On the cost-reimbursable side of federal work there is a separate question worth raising with your accountant early: employer retirement contributions are treated under the federal cost principles, which set conditions on when and how such costs are allowable and reimbursable. That is a contract accounting matter rather than a plan design matter, but the two decisions interact, and the time to align them is before the plan document is signed. Beyond that the review is the standard one and it is overdue at most firms this size: benchmark the all-in cost against what a forty-five person plan can now obtain, name a 3(38) or 3(21) fiduciary in writing, adopt an investment policy statement, and keep a record of the decisions.

The Orange County wrinkle

The Orange County version of the federal fringe question is sharper than the Los Angeles one, because the county contains two installations and the base-support work around them is services work. Under the Service Contract Act, and under Davis-Bacon on covered construction, an employer owes a health and welfare fringe amount per hour worked on covered contracts, and that obligation can generally be satisfied either by paying cash or by contributing to a bona fide benefit plan. The structural point worth knowing before you plan anything: CalSavers accepts no employer contributions at all, so registering with it cannot discharge a fringe obligation by any amount. It is an employee-funded Roth IRA and there is no employer side to it. Whether your contract is covered, which wage determination applies, and how the annualisation and vesting requirements bear on your contributions are legal and certified-payroll questions — take them to counsel who does government contracting, not to a benefits brochure.

The second Orange County difference is who you are bidding against for people. Your electrical and RF engineers, test technicians and quality staff are inside a twenty-minute radius of Irvine's technology and medical device employers, who hire the same skills and pay on a different scale. Cybersecurity flowdown has also arrived at the small end of this supply chain in a way it had not five years ago, and a forty-five person electronics firm that must now demonstrate controls against federal requirements is spending its scarce administrative capacity there. That is exactly the moment a bundled 401(k) goes another three years without anyone reading the fee disclosure.

We are bidding facilities support work at a base in the county. What has to be in place first?

Before the plan question, the contract question: which wage determination applies, what the hourly health and welfare fringe rate is, and whether your work is covered at all. That is counsel and a certified-payroll specialist, not us. Once you know it, the benefits decision is whether to pay the fringe as cash or route it through a bona fide plan. If you route it through a plan, the plan has to exist, accept employer contributions, and allocate them in a way that satisfies the annualisation and vesting rules — none of which CalSavers can do, since it takes no employer money whatsoever. Build the plan before the first covered payroll, because retrofitting this is where firms get findings.

Do the fringe contributions go into the same 401(k) as everyone else's money?

Usually into the same plan but as a separate contribution source with its own allocation rules and its own vesting treatment, tracked against hours worked on covered contracts. Keeping it as a distinct source is what makes the arithmetic auditable later: you need to be able to show, employee by employee and period by period, that the required fringe amount was actually contributed. The document has to say all of this explicitly. Do not let a recordkeeper improvise it inside a standard prototype document, and do not accept a design from anyone who has not done Service Contract Act work before.

Half our revenue is cost-reimbursable. Is the employer contribution reimbursable?

Retirement plan contributions fall under the federal cost principles governing contract costs, which set conditions on allowability — including how and when contributions are funded and how they are allocated. This is genuinely technical territory and it is decided by your contract accounting position rather than by anything on a benefits page, so the answer has to come from your government contract accountant or counsel. Raise it before you adopt a plan or change the contribution formula, because the design that is best for retention is not automatically the design that is cleanest under a cost-reimbursable contract, and reconciling them afterwards is expensive.

Not the Irvine cash package, and pretending otherwise wastes an interview. What a firm your size can offer is specificity: an employer contribution stated as a number rather than "competitive benefits", a vesting schedule, low plan costs so more of the balance stays with the employee, and a named independent fiduciary rather than whatever fund lineup the payroll vendor supplied. Candidates who have worked at a larger employer read a fee disclosure the way they read a datasheet. A cheap, well-run plan is a genuine differentiator with that audience — a real one, not a decisive one.
