Orange County's recreation sector is anchored by two theme parks and a county-wide sports economy — but the businesses reading this page are the studios in the business parks, and their first problem is not the mandate.

The short answer

Orange County's recreation and fitness businesses sit in master-planned retail centres and business parks rather than converted storefronts, and the county's largest recreation employers are its theme parks. For an independent studio in Irvine, Tustin or Huntington Beach, the CalSavers question is straightforward once a harder one is settled: which of your instructors are W-2 employees and which are genuinely independent.

Where do gyms, fitness studios and recreation cluster in Orange County?

Two amusement operations dominate the sector's payroll here — the Disneyland Resort in Anaheim, generally counted as the county's largest private employer, and Knott's Berry Farm on Beach Boulevard in Buena Park. Both sit in the same census category as a spin studio and share essentially nothing with one. Around them the resort district supports a secondary layer of entertainment and recreation operators along Harbor Boulevard and Katella Avenue that staff to a visitor calendar rather than a membership calendar.

The fitness trade itself follows the master-planned commercial centres. The Irvine Spectrum, the Woodbridge and Northwood village centres, the District at Tustin Legacy, South Coast Metro in Costa Mesa and Fashion Island in Newport Beach carry most of the county's boutique studios, usually as inline tenants under institutional landlords on standardised leases. Huntington Beach and the coast run a genuinely different version of the business — surf and skate instruction, beach volleyball, outdoor training and seasonal camps that peak between Memorial Day and Labor Day rather than in January.

The county's third recreation economy is golf and youth sports, and it is larger here than its profile suggests. Courses run from Newport Coast through Tustin Ranch, Anaheim Hills and Yorba Linda, each carrying a payroll of grounds crew, pro-shop staff, cart attendants and food service. The Orange County Great Park sports complex in Irvine, along with the club volleyball, soccer, swim and gymnastics academies spread through Irvine, Tustin, Fountain Valley and Huntington Beach, employs a large part-time coaching workforce that is often paid per session — which is the same classification question in a different uniform.

Registration is free and the employer never touches the money. The exemption route is the one most gyms, fitness studios and recreation miss: sponsoring your own plan does not exempt you automatically — you have to certify it, and the certification repeats.

What makes this industry harder than the mandate assumes?

The law treats every employer alike. The payroll underneath does not cooperate:

  • Per-class instructor pay is the default operating model in this county's studio market, which makes the classification question structural rather than incidental.
  • Master-planned retail rents are high and largely non-negotiable, so any fixed monthly benefit commitment competes directly with the lease.
  • Coastal and camp-driven recreation peaks in summer, so headcount crosses and re-crosses the eligibility line inside a single year.
  • Multi-unit and franchised operators are unusually common here, and separate LLCs per location do not produce separate small-employer answers.
  • Owners are typically coaching or managing the floor themselves, so anything needing monthly handling will not get handled.

Typical headcount in this sector runs 5-50 employees, and roughly 15-25% of businesses (est.) currently sponsor a plan of any kind — which is why the mandate lands here harder than in sectors that were already covered.

What plan design actually works?

With a clean W-2 census, the design that fits a business-park studio is deliberately plain: a 401(k) with automatic enrollment and automatic escalation, eligibility set at a year and 1,000 hours, and every dollar of employer money discretionary and declared after the year is known. The seasonality here is not January-and-September so much as summer-and-not, particularly along the coast, and a plan that fixes an employer commitment in a strong quarter will be honouring it in a weak one.

Where the arithmetic turns is the owner. CalSavers is a Roth IRA underneath, capped at $7,500 for 2026 and phased out at roughly $168,000 single and $252,000 joint — income levels that a successful multi-location operator in this county reaches routinely. The Orange County wrinkle

Here is the part of this page worth your time. Orange County studios are, if anything, more 1099-dependent than their Los Angeles counterparts, because the business-park lease model favours an operator who carries almost no fixed payroll and pays instructors per class. California generally applies the ABC test, and its second prong — whether the work sits outside the usual course of the hiring entity's business — is unforgiving for a business whose entire product is instruction. The person who should answer that for your studio is employment counsel, not us and not your payroll provider. We take no position on how it comes out. What we will say plainly is that a misclassification finding carries back wages, unpaid payroll tax, workers' compensation exposure and wage-and-hour claims that make the CalSavers penalty look like a rounding error, and that spending money on plan design before that review is spending it in the wrong order.

The county-specific complication is that Orange County has fewer of the municipal wage ordinances that keep Los Angeles operators nervous, which produces a false sense of quiet. State law does not care. There is no local buffer here, and the ABC test applies identically in Irvine and in Inglewood. What Orange County does have in unusual concentration is franchised and multi-unit fitness operators — the master-planned retail format suits chains — and with them the controlled-group problem, which is genuinely more common in this county than across the line.

Our instructors teach at three different studios around Irvine. Does that make them contractors?

It is a relevant fact and it is not the answer. Working for multiple businesses bears on the analysis, but California's tests look at the whole relationship — who sets the schedule and the rate, whose members they are, whether the worker has an independently established business of the same kind, and whether the work is inside your usual course of business. We run summer surf and beach camps in Huntington Beach. Do seasonal staff count?

For CalSavers, yes — eligibility is age 18 and employment, with no waiting period the employer can impose, and enrollment must happen within 30 days. That is precisely why the state program is administratively awkward for a summer-heavy operation and why a plan of your own can be easier despite sounding harder: a 401(k) document can require a year and 1,000 hours before eligibility, which keeps a seasonal roster out of the plan entirely. Does being near the Anaheim resort district change anything for a small studio?

Not for the mandate, which is statewide and keyed to your payroll rather than your address. What it changes is your labour market. Competing for part-time staff against the resort operators and their hotel and food-service neighbours means competing against employers who already offer benefits, and a studio's honest advantage there is schedule flexibility rather than compensation. That is worth being realistic about before treating a retirement plan as a hiring tool — what benefits actually do for retention, looked at honestly.
