Los Angeles County's technology economy is really three: advertising, streaming and games infrastructure on the Westside, hardware and space work in El Segundo and the South Bay, and enterprise software downtown and in Pasadena. What they share is a headcount that moves in steps rather than curves. Each step crosses a CalSavers tier, and somewhere past a hundred participants a 401(k) picks up an annual audit nobody budgeted for.
Where do iT services, software and tech startups cluster in Los Angeles County?
Silicon Beach is the label and it covers a genuine corridor. Santa Monica carries the densest concentration — Colorado Avenue and the blocks around the E Line terminus, the Water Garden and the Bergamot area — running south through Venice and Abbot Kinney to Marina del Rey. Playa Vista, built on the old Hughes Aircraft site where the Hercules hangar still stands, was developed as campus space and is leased that way. Culver City picks up from there: the Hayden Tract's converted industrial blocks and the newer offices around the Culver City E Line station carry streaming, post-production technology and the engineering groups attached to them.
El Segundo and the South Bay are the county's hardware corner and a different business entirely. Rocket Road, Douglas Street and the Continental Park office district sit alongside Los Angeles Air Force Base, the home of Space Systems Command, in a corridor that has been building spacecraft and defense electronics since the 1950s. The payroll shape there is engineers on W-2, cleared work with slower hiring, technicians and test staff, and far less contractor churn than the Westside.
Inland, the Arts District and the Figueroa corridor downtown carry enterprise software and the fintech and logistics-technology firms that grew up near the customers. Pasadena is its own engine: Caltech and NASA's Jet Propulsion Laboratory, which Caltech manages, produce a steady flow of spin-outs, and the Green Street and Union Street blocks of Old Pasadena hold a good share of them. Burbank and Glendale carry the media companies' technology and animation groups. Sherman Oaks and Woodland Hills hold the managed-service providers and IT consultancies serving the valley's own business base. From Norwalk the Westside is twenty-five miles and, at the wrong hour, ninety minutes.
What does CalSavers require of a LA County iT services, software and tech startup employer?
The same thing it requires everywhere in California, and every deadline has already passed. If you have one or more W-2 employees, you must either register with CalSavers or sponsor a qualified retirement plan and certify an exemption.

Registration is free and the employer never touches the money. The exemption route is the one most iT services, software and tech startups miss: sponsoring your own plan does not exempt you automatically — you have to certify it, and the certification repeats.
What does ignoring it cost?
$250 per eligible employee at 90 days past notice, another $500 at 180 days, then $500 per employee every year you stay non-compliant (the full mechanics). For a 22-person operation that is $16,500 in the first cycle and $11,000 a year after — more than a plan would cost. What makes this industry harder than the mandate assumes?
The law treats every employer alike. The payroll underneath does not cooperate:
- The engineering bench is a mix of W-2 staff, agency contractors and overseas developers, so the headcount that matters for the mandate is smaller than the org chart and harder to pin down.
- Headcount moves in steps — five to fifty to a hundred inside eighteen months — and the deadline that applied was the one for the tier the company was in when it crossed, not the tier it is in now.
- Founders treat benefits as a post-Series-A item, but the mandate does not wait for a term sheet and the penalty accrues per employee, per year.
- Candidates arrive comparing a match against large-employer offers stated in percentage points, so the plan is a hiring instrument well before it is a compliance one.
- Equity planning consumes the entire founder conversation, and RSU vesting simultaneously distorts the compensation figure the plan itself is calculated on.
Typical headcount in this sector runs 5-100 employees, and roughly 55-70% of firms (est.) currently sponsor a plan of any kind — which is why the mandate lands here harder than in sectors that were already covered.
What plan design actually works?
Design for the company you will be in three years, because retrofitting is what costs money here. A safe-harbor 401(k) with immediate or thirty-day eligibility fits this labor market — a twelve-month waiting period reads as cheap to an engineering candidate, so control cost through the match formula rather than through the door. Automatic enrollment is generally required for plans established after 29 December 2022 once a company is past ten employees and three years old, so build it in at adoption. And watch the participant count: past roughly a hundred participants with account balances, the plan needs an independent audit each year, with a transition rule that softens the first crossing. Cashing out or rolling over small terminated balances — the involuntary distribution threshold was raised to $7,000 under SECURE 2.0 — is the ordinary way growing plans keep that count honest.
Two things specific to this industry are worth getting right at drafting. First, the plan document must say how equity compensation is treated, because a vesting event can multiply a single paycheck and a deferral election written as a percentage will do something nobody intended. Second, a payroll-bundled 401(k) is a perfectly good recordkeeper and is not a fiduciary: if nobody is named in writing as the plan's investment fiduciary, the founder or the head of finance holds that role personally, whether or not they know it. Appointing a 3(38) moves the investment decisions and the liability that comes with them.

The LA County wrinkle
Nowhere else does a technology payroll sit this close to an entertainment payroll, and it changes who is actually on your census. Ad-supported streaming, visual effects, games and adtech tie headcount to production slates and advertising cycles rather than to product roadmaps, so the same forty-person company can be sixty for a quarter. A large part of the creative and engineering talent moves through entertainment payroll companies or bills through loan-out corporations, which means those people appear on somebody else's W-2 — genuinely outside your count, until a joint-employment or leased-employee question says otherwise. Get an accurate list of who your employer of record actually is for each person before you calculate anything.
The municipal layer is the second Los Angeles distinction. A company inside the City of Los Angeles pays a gross-receipts business tax and must hold a business tax registration certificate; Santa Monica levies its own business licence tax, and Culver City, Pasadena and Burbank each run their own registrations. A firm with a Santa Monica office and remote staff in four cities is already managing several local registrations, none of which produces a single reliable headcount number. And the remote question cuts the other way on the mandate: CalSavers reaches your California employees, while a 401(k) you sponsor covers the engineer you hired in Denver as well.

LA County iT services, software and tech startups questions
We are pre-revenue with eight employees on payroll. Can this wait until we raise?
No, and it costs nothing to fix. Employers with five to forty-nine employees were due by 30 June 2022 and the one-to-four tier closed on 31 December 2025, so a company with eight W-2 people is already past its date. Registration with CalSavers is free, takes about twenty minutes and involves no employer contribution at all — there is no funding argument for waiting. If you would rather sponsor a real plan, note that the SECURE 2.0 startup credits are worth up to $5,000 a year for three years and are most valuable exactly at your stage.
Half our engineering team are contractors through an agency, and four more are overseas. Who counts?
Take them in two groups. People placed by a staffing agency are generally the agency's W-2 employees and count on the agency's census, not yours — but leased employees can still be pulled into your coverage testing under IRC § 414(n) even though someone else runs their payroll, and a long placement supervised entirely by your managers invites a joint-employment question. Developers working abroad with no United States earnings are generally excludable as nonresident aliens for plan testing and are outside a California mandate regardless. The list that matters for CalSavers is your California W-2 payroll.
Our payroll provider bundled a 401(k) in when we onboarded. Are we finished?
Two things left. Sponsoring a plan does not exempt you from CalSavers automatically — somebody has to certify the exemption, and the certification repeats, which is how companies that genuinely have a plan still collect notices. Then ask who is named in the plan document as the investment fiduciary. In most payroll-bundled arrangements the answer is the employer, meaning a founder is personally responsible for selecting and monitoring the fund lineup, usually without having been told so.
We just passed a hundred employees. What actually changes?
The compliance shape, not the deadline — the 100-plus tier was due 30 September 2020, so if you were never registered the exposure has been accruing. Going forward, a plan generally needs an independent audit once it has around a hundred participants with account balances at the start of the plan year, and there is a transition rule that lets a plan hovering near the line stay on the small-plan filing for a year. Budget for the audit before it is due, and clean up terminated participants with small balances first, because they count.
